1. Service Description

Mail Tracker provides a service to track email opens using tracking pixels embedded in emails. The service interacts with your connected Google Account via the Gmail API to link trackers to sent emails and retrieve metadata (like subject lines). Features include trackers with/without signature (based on your plan), read notifications, and a dashboard to view tracking history.

2. User Accounts & Registration

You must register and log in using your Google Account to use Mail Tracker. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3. Google Account Integration & Permissions

Connecting a Google Account is mandatory. We request read-only access to your Gmail (`https://www.googleapis.com/auth/gmail.readonly`). This permission is used exclusively to retrieve email metadata (subject lines and recipient information) from your 'Sent' folder to display in your Mail Tracker dashboard and in tracking notifications. We do not modify, delete, or add labels to your emails. All access is strictly read-only. Your continued use of the service implies consent to these permissions. You can manage app permissions in your Google Account settings.

4. Data Collection & Use

We collect user information (Google email address, name, profile picture, preferences), email tracking data (timestamps, counts, email metadata), and payment information (Stripe subscription). This data is used to provide and improve the service, manage subscriptions, and send notifications. Please refer to our Privacy Policy for full details.

5. Mail Tracker Communication Tracking

All communications sent by Mail Tracker (notification emails, confirmations, service updates, etc.) contain read trackers that inform us when these emails are opened. This tracking information is used exclusively for internal purposes to improve our communications and measure the effectiveness of our messages. This data is never shared, sold, or transmitted to third parties. It remains strictly confidential and is processed in accordance with our data protection policies.

6. User Responsibilities & Conduct

You agree to use Mail Tracker in compliance with all applicable laws, including anti-spam and privacy regulations (e.g., GDPR). You must not use the service for harassment, spamming, illegal activities, or violating third-party rights. You are solely responsible for the content of emails sent using our trackers.

7. Subscription Plans, Payments & Billing

We offer Free, Monthly, and Yearly subscription plans. Trackers without signature are only available on paid plans. Payments are processed via Stripe and are subject to their terms. Subscriptions auto-renew unless cancelled. You can manage your subscription (upgrade, downgrade, cancel) through your user dashboard or the Stripe Billing Portal. Cancellations take effect at the end of the current billing period. If payments fail, we provide a grace period and retry attempts before suspending the account. No refunds are provided.

8. Intellectual Property

Mail Tracker and its original content, features, and functionality are owned by Mail Tracker and are protected by international copyright and trademark laws. You own the content of the emails you send.

9. Termination & Suspension

You may terminate your use of the service by cancelling your subscription. We may terminate or suspend your account for violations of these Terms, non-payment, illegal activities, or discontinuation of the service.

10. Disclaimers

The service is provided 'as is' without warranties. Tracking accuracy may be affected by factors outside our control (e.g., email client settings, web browser restrictions). The service relies on third-party APIs (Google, Stripe), and their availability may impact our service.

11. Limitation of Liability

To the maximum extent permitted by law, Mail Tracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Mail Tracker from any claims, damages, or expenses arising from your use of the service or violation of these Terms.
